DACA Guide Chapter 2 Summary: President Obama Creates DACA Via Executive Order

Deferred Action for Childhood Arrivals (DACA) was/is a stopgap measure that was put into place by President Obama in 2012 to address and protect DREAMers. President Obama announced and implemented DACA through the power of Executive Order. Through this power, the President may implement specific discretion relating to the enforcement of specific laws. Through DACA, President Obama allowed DREAMers to sign up for the program to receive a work permit and a 2-year deferral from deportation. This 2-year period can be continuously renewed, until a more permanent solution in passed by Congress. President Obama also tried to expand DACA with a measure called Deferred Action for Parents of Americans (DAPA), which sought to grant deferred status qualifying undocumented immigrants who have U.S. citizen children. The attempt to implement DAPA ultimately failed. A description of DACA, the power of Executive Orders, and the importance of the case of Plyler v.
